This Privacy Policy is a part of our Terms of Use.  By using this site or our online store, you agree to be bound by and comply with this Privacy Policy and our Terms of Use. 

SECTION 1 – AGE RESTRICTIONS ON ACCESS AND PURCHASES

You must be at least 18 years old to access this site. If you are under 18 years old you are not permitted to use this site for any reason. You must be of legal age required by the state or province you are in to purchase our products. It is your responsibility to know whether you are legally able to purchase our products.

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address and order history.  We also use cookies, web beacons or other tools that collect information that make it easier to use our store and our site.

Email marketing: By providing us with your email address, you are giving us permission to send you emails about our store, new products and other updates. You have the opportunity to unsubscribe from these emails at any time by clicking the “Unsubscribe” button included at the bottom of each email.

How we use your information. In general, we use the information we collect primarily to provide, maintain, protect and improve our current site and products and to develop new products. We use personal information collected through our site as described below and described elsewhere in this Privacy Policy to:

• Communicate with you about promotions, upcoming events and news about products and services offered by Lily's Lighthouse and our selected partners, and for other marketing purposes of Lily's Lighthouse;

• Protect, investigate and deter against fraudulent, unauthorized or illegal activity.

How do you get my consent?

By providing us with personal information to complete a transaction,  placing an order, arranging for a delivery or returning a purchase you are consenting to our collecting and using your information (your credit card information is discussed in Section 4 below).

SECTION 4 - DISCLOSURE

We do not share your personal information with third parties without your consent other than with the following:

• Third Party Service Providers. With third parties who work on our behalf, provided that such third parties provide at least the same level of privacy protection as required by this Privacy Policy;
• Lawful Requests. To comply with laws or to respond to lawful requests and legal process (provided that we will endeavor to notify you at the address you have given us if we have received a lawful request for your information);
• Protection of Rights and Property. To protect the rights and property of Lily's Lighthouse, our partners, our agents, customers and others including to enforce our agreements, policies and  terms included in this Privacy Policy or our Terms of Service;
• Emergency. In an emergency, including to protect the personal safety of any person; and
• Corporate Restructuring. For the purposes of a business deal (or negotiation of a business deal) involving a sale or transfer of all or a part of our business or assets (business deals may include, for example, any merger, financing, acquisition, divestiture or dissolution transaction or proceeding). In the event of an insolvency, bankruptcy, or receivership, personal information may also be transferred as a business asset. If another company acquires our company, business or assets, that company will also acquire and possess the personal information collected by us and will assume the rights and obligations regarding your personal information as described in this Privacy Policy.

SECTION 5 – PAYMENT PROCESSING

Our store is built on an e-commerce software platform called GoDaddy that allows us to sell our products and services to you.

Payment: If you provide us with your credit card information during the payment process, we send it to our PCI-DSS compliant payment gateway for processing using SSL encryption technology. Your credit card information is stored for recurring subscription orders as well as within my account for faster checkout experience.  All direct payment gateways comply with the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.  PCI-DSS requirements help ensure the secure handling of credit card information by our store and our payment processors and service providers.

SECTION 6 - THIRD-PARTY SERVICES

Our Policy does not cover any third party services. To learn about those third parties' privacy practices, please read their privacy policies.

Links: When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy policies.

SECTION 7 - SECURITY

To protect your personal information, we take reasonable precautions and follow generally accepted industry practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. Your personal information is protected by your password – never share this password with anyone.  Lily's Lighthouse will never contact you to ask you for your password.  If you provide us with your credit card information, the information is transmitted to our server using  secure socket layer technology (SSL) which employs the AES-256 encryption standard.

SECTION 8 - AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you consent to any of your minor dependents using this site.

SECTION 9 – U.S. LAW APPLIES

This site is intended for users located in the United States. By sending us your Personal Information from outside the U.S., you consent to the application of U.S. law and to the use and disclosure of your personal information consistent with this Privacy Policy. It is up to you to determine whether accessing this site and purchasing our products are legal where you are. You access this site and purchase our products at your own risk, and you are responsible for compliance with all applicable laws, rules, regulations and treaties.

-The sources of personal information from whom we collected are: directly from our guests, third-party sites or platforms that you link with your registration account, analytics tools, social networks, advertising networks, and third-party services that update or supplement information we hold about you. 

-The business or commercial purposes of collecting personal information are as summarized in our “notice at collection” section, and as described in more detail above in this Privacy Policy.   

-We disclosed the following categories of personal information for a business purpose in the last 12 months: identifiers/contact information, demographic information (such as gender and age), payment card information associated with you, commercial information, Internet or other electronic network activity information, geolocation data, audio, electronic, visual or similar information, and inferences drawn from the above. 

-We disclosed each category to third-party business partners and service providers, third-party sites or platforms such as social networking sites, and other third parties as described in more detail above in this Privacy Policy. 

-As the term is defined by the CCPA, we “sold” the following categories of personal information in the last 12 months: identifiers/contact information, Internet or other electronic network activity information, and inferences drawn from the above. 

-We “sold” each category to advertising networks, data analytics providers, and social networks. 

-The business or commercial purposes of “selling” personal information is for third-party companies to perform services on our behalf, such as marketing, advertising, and audience measurement. 

-We do not “sell” personal information of known minors under 16 years of age.

YOUR RIGHTS 

Right to Access. If you are a California resident, you have the right to request, up to two times each year, access to categories and specific pieces of personal information about you that we collect, use, disclose, and sell.  

Right to Delete.  If you are a California resident, you have the right to request that we delete personal information that we collect from you, subject to applicable legal exceptions.  

Right to Opt Out of Sale of Personal Information. If you are a California resident, you have the right to “opt out” of the “sale” of your “personal information” to “third parties” (as those terms are defined in the CCPA).  

Process to Make a CCPA Request  

-Making Access and Deletion Requests.  In order to make an access and deletion request, please contact us by mailing the request to us at our physical address below.  Before completing your request, we may need to verify your identity. We may request  documentation or information solely for the purpose of verifying your identity. 

-Instructions for Authorized Agents Making Access and Deletion Requests.  You may also use an authorized agent to submit an access or deletion request on your behalf.  Authorized agents may submit access and deletion requests by mailing us at our physical address below. An authorized agent must have your signed permission to submit a request on your behalf or provide proof that they have power of attorney in accordance with California probate law. Authorized agents that are business entities must be registered with the California Secretary of State to conduct business in California. Before completing requests from authorized agents, we may contact you directly to confirm you’ve given your permission and/or to verify your identity.  

-Making Requests to “Opt Out” of the “Sale” of “Personal Information.”  To submit a request to opt out of the sale of your personal information, you may send an email to info@lilyslighthouse.org with the subject line “do not sell info.”  You may also use an authorized agent to submit a request to opt out on your behalf if you provide the authorized agent signed written permission to do so.  Authorized agents may submit requests to opt out by mailing us at our physical address below. You have the right not to receive discriminatory treatment for the exercise of your privacy rights conferred by the CCPA.  

Shine the Light Act 

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by certain members of Lily's Lighthouse  to third parties for the third parties’ direct marketing purposes.  We do not share guests’ personal information with third parties for those third  parties’ direct marketing use unless a user elects that we do so.  To make such a request, please write us at: CA Privacy Rights, Lily's Lighthouse, PO Box 4312, San Clemente, CA 92674.   

Removal of Content.  If you are a California resident under the age of 18, you are not permitted to use this Site.  California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted.  To make such a request, please write us at our address below. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.

For the reporting period, we provided California consumers with information about certain controls and choices they could use to effectuate opt-outs through third-party tools for which we do not maintain metrics.
